When it comes to different levels of crimes, misdemeanors are lesser offenses than felony charges. Misdemeanor classifications range from Class I felonies (the most serious) to Class III misdemeanors, the least severe. The absolute maximum penalty for a misdemeanor can be six months in jail. At the same time, a person who commits their first crime will not even go near a prison. At thirty-one consecutive offenses or more, they may end up behind bars but still hope that society will pardon them and give them another chance to take steps towards rehabilitation as required by law.
The misdemeanor conviction will not go away, but it can still have benefits. A "Set Aside" designation is the closest thing to a misdemeanor in Arizona and has some of the same benefits as other misdemeanors.
There are no mandatory sentences for felonies in Arizona, but if a person is convicted of their first felony offense, they may be eligible to receive probation. In essence, this means that even though the defendant will not necessarily get jail time when they're on probation, it's possible and up to 1 year-time could be served without parole or early release from prison.
As experienced criminal defense attorneys in Arizona, Southern Arizona Law has the power to negotiate with judges and prosecutors for our client's rights. However, we can't promise that every client will have their charges reduced or dismissed due to ethical reasons; it all depends on what they've done wrong in comparison to other charges as well as prior offenses.
